A letting agent has been slammed after taking a whopping £5.5m in housing benefit from a charity housing homeless people. Campaigners have described the act as a, ‘worrying arrangement.’

Investing Solutions, operational across seven London boroughs, received the money over a two-year period from the Fresh Start Housing, which pledges to find properties for single, homeless men.

Investigation

According to a BBC investigation, the company, based in York Road, Battersea, has earned an £11,568 annual profit from one single property. The company nor the charity have broken the law with their actions, but understandably, campaigners have described the arrangement as ‘exploitation.’

The investigation found evidence of some Investing Solutions properties were substandard, with issues such as rat infestation and damp in many homes.

Candida Jones, Labour councillor at Wandsworth Council, commented that, ‘it is shocking that so much public money can be paid to house some of our most vulnerable people in filthy and dangerous conditions.’ She feels that, ‘in a properly regulated housing market exploitation of this kind could not have happened.’[1]

‘I can’t understand why alarm bells were not ringing at Wandsworth Council. They are flat-footed when it comes to investigating local landlords.’[1]

As spokeswoman for housing charity Crisis said that longer-term tenancies and an obligatory register for landlords would assist in protecting tenants. She noted that, ‘too often, people who are at risk of homelessness are in a terrible situation.’[1]

‘It is evident the people at the lower end of the market are so vulnerable. We know that private companies are exploiting people-it is worrying. In a market where demand has grown so much, it is unsurprising that this sort of thing is happening.’[1]

However, company director Samir Patel, denied that there was a link between Investing Solutions and charity Fresh Start Housing. He would neither confirm or deny that £5.5m was given to his company during the period, but noted that figure was possibly accurate.

Mr Patel said,’ we lease properties from landlords. We house homeless people in need. We do not charge them any fees. These clients are in desperate need of housing. I could rent to working people and get more money but we think of this as a win-win situation because the homeless are getting homes.’[1]

‘If the council could house them there would not be a demand for our homes,’ he added.[1]

A leading Knightsbridge based estate agents is urging landlords to be on their guard against a surge of sub-letting scams.

Patterson Bowe has offered advice to letting agents and tenants alike, with the intention of helping them avoid such problems.

Many landlords have recently approached Patterson Bowe’s lettings team in search of new tenants, having realised that their properties had been sub-letted illegally, without their knowledge or consent.

As such, the agent is calling on all landlords to carry out thorough diligence checks on all tenants, before signing any contracts.

‘An undersupply and increased demand in the current market has left room for certain tenants to bend the rules where they can,’ said Stuart Patterson, owner and managing director of Patterson Bowe. ‘We have been contacted by both landlords and tenants looking for advice because they have fallen victim to these scams, particularly illegally sub-letting property throughout Prime Central London. Often these are short term tenants who are here from overseas and searching online for temporary accommodation without appropriate knowledge or advice,’ he added.[1]

Alistair Bowe went on to add that, ‘a quality letting agent will not only have an awareness of these kind of practices, but will also be to provide sound advice to clients on how to avoid them.’ He said that,’ our years of experience have taught us that relying on computerised reference checks alone is not enough to ensure the quality and reliability of tenants. Once we have conducted the usual online checks we also meet each tenant in person to retain in depth background information from them and build a detailed and reliable profile for our clients.’[1]

A high street estate agent has slammed the newest communication to the industry on Consumer Protection Regulations, branding it as a, ‘complete mess,’ and, ‘nothing short of ridiculous.’

Criticism

Jonathan Newell, director of SalesBoards Estate Agents in Exeter, believes that his company’s situation shows the extent of the issues with the publication. ‘We pride ourselves on being open and honest with our fees, but the new legislation now states that our fees have to be advertised inclusive of VAT,’ he said.[1]

‘Since VAT was introduced in 1973, agents fees have always been quoted exclusive of VAT and that is what the public have become used to. So our usual fee of 1.25% plus VAT now has to be advertised at 1.5% including VAT, which in my mind makes a very competitive fee sound no better than typical,’ he added.[1]

Avoidance

Mr Newell went on to say that SalesBoards, like many other firms, has decided to try and dispel any confusion by removing any reference to fees from its adverts and publications.

He noted that, ‘a quick browse of last week’s local newspaper revealed that only one out of 23 agents included details of their fees in their adverts.’[1]

‘Given that the Consumer Protection Regulations are supposed to make things better rather than worse for the consumer, it seems they may have fallen short of achieving their intended goal,’ Newell concluded.[1]

The Property Obmudsman has moved to expel another letting agent following its lack of compliance with parts of the Code of Practice for Residential Letting Agents.

Bruten & Co Limited, a sales and letting agent based in Notting Hill Gate in London, has been banned from the Ombudsman for at least two years for its negligence.

Complaints

A decision to ban the company from the Obudsman followed a complaint from would-be tenants who highlighted concerns over many features of Bruten & Co’s level of service when applying to rent a property.

Coming in two parts, the initial section of the complaint centered around trying to arrange a tenancy, This consisted of three elements, two of which were upheld by the Ombudsman, Christopher Hamer. In addition, the second part, focusing on the handling of the prospective tenants’ complaint was also upheld.

The prospective tenants found that the agreement that they were sent featured a substantial extra term, which was not in the initial offer form that they had signed. Bruten & Co refused to amend the tenancy agreement, or refund the deposit and administration fees. Additionally, the company did not provide information on how the utility bills for the property would be worked out.

What’s more, the letting agent refused to sort out a complaint made to them by email, with a complaint sent through the post also not dealt with in a timely manner. Delivering a verdict, the Ombudsman decided that all of these issues involved breaches of the Code of Practice. As a result, he awarded the complainants a total of £768 in compensation, a figure that Bruten & Co still has not paid.

Impartial review

Mr Hamer said that, ‘my role as Property Ombudsman is to impartially review complaints made by members of the public against agents based on the evidence that is submitted to me. I aim to promote a resolution in full and final settlement of a complaint, and will determine appropriate redress where I am satisfied that the actions of an agent have disadvantaged a complainant. In this case, I considered it to be fair in the circumstances that Bruten & Co pay the sum of £618 to the complainants to cover the holding deposit and administration fees that had not been returned to the complainants.’

In addition to this, I considered that a further award of compensation for the aggravation, distress and inconvenience caused as a result of the failings in Bruten & Co’s complaints handling was also merited. I therefore made a total award of £768.’[1]

The Disciplinary and Standards Committee of The Property Ombudsman said that Bruten & Co’s shortcomings regarding the agreement and payment of the award were serious breaches of the Code of Practice.

Bruten & Co had been members of the Ombudsman since 1998.

Hamer concluded by saying, ‘agents cannot avoid paying awards if they jump from one scheme to another. Under the guidance of the Department for Communities and Local Government the three approved redress schemes will not accept into membership any agent that does not meet its obligations to another scheme. Once Bruten & Co have met their financial obligations they will be free to join another scheme. After the two years have passed they will also be free to re-join TPO, but they need to pay the award.’[2]

easyProperty looking to secure Premier deal

The football season returns in just three days and with optimism rife, predictions made and new signings in place, there is still one deal that is yet to be concluded.

After lengthy negotiation, the proposed easyProperty sponsorship of Tottenham Hotspur is still yet to be concluded.

Signing?

In March, the Daily Telegraph said that the online letting agency was in talks with the Premier League outfit over what it described as, ‘a multi-million pound sponsorship deal.’ Just the next day, marketing website The Drum, revealed that easyProperty was, ‘poised’ to sign a deal with Spurs.

However, with the start of the new Premier League campaign just days away, there is still no official word from White Hart Lane. Spurs’ website does not list the letting agency as one of its sponsors.

A representative from easyProperty commented, ‘they are in late stage talks but nothing has been agreed. The fact that Tottenham is the centre of a major regeneration scheme is of great interest and adds additional interest to the sponsorship.

Good company

If the deal is concluded, easyProperty would be in good sponsorship company, with Carlsberg, Marathon Bet, StubHub and Thomas Cook amongst Spurs’ official partners.

Reportedly, easyProperty are looking to have their logo utilised on the numerous advertising hoardings around the pitch, alongside buying into hospitality suites and player access. The Telegraph reports that a person, ‘close to the deal,’ said that the letting agent also wants to get, ‘involved in the local community,’ through any sponsorship deal.[1]

Considering a deal is eventually struck, the move could be considered as Champions League qualification for easyProperty. However, should an agreement not be reached given the advanced announcement, the letting agent will have certainly put one in its own net.
